Pixsee Smart Baby Camera (hereinafter the “Baby Camera”) is a product of Shennona Co., Ltd. (hereinafter “We”, “Us” or “Our”). This Privacy Policy describes how We collect, process, use and protect data about you or your baby when you use any function or service (collectively the “Pixsee Services”) offered through the Baby Camera, Pixsee application (hereinafter the “Application”) or the website at www.pixseecare.com (hereinafter the “Website”).
Please be advised that Our Website or Application may contain external links to other websites or applications that are not operated by Us. When you click a third-party link, you will be redirected to a third-party website or application. We strongly recommend that you should review the privacy policy of each website or application. We have no control over the service or privacy policy of any third-party website or application, and assume no liability thereto.

  • AI training
    • To train Our AI algorithm to more efficiently identify and alert the baby’s needs, on basis of the baby’s cries recorded by the Baby Camera, and the corresponding explanations of such cries provided by the user.
    • Pictures shot by the Baby Camera and pictures you upload will be used as materials for AI to identify different types of needs in pictures that you set to identify.
  • Pursuance of legitimate interests and exercise of rights/performance of legal obligations
    • To detect, prevent or investigate security incidents, fraudulent behaviors or other illegal activities.
    • In the event of violation of service terms, consumer dispute, nonperformance of obligation, infringement, criminal activity, etc., We may, for the purpose of exercising or defending a legal claim, use your data to the extent necessary. For example, We may disclose data to a competent authority or to the judiciary.
    • Where it is required by law, We may, for the purpose of performing a legal obligation, disclose your personal data to a competent authority or to the judiciary.

To fully provide Pixsee Services, We use various third-party service solutions (such as data storage, audio or video streaming/event logging, marketing, website performance analysis, etc.). The relevant member information, audiovisual data, order information, user data, and the alike are stored in the territory where the server of such a third-party service is located, for use by Us at Our location (Taiwan).

4. To whom We disclose data

We do not lease, lend or sell your data to any third party. Data of Pixsee Services may only be disclosed to the following persons or entities:

5. How long do We store and use data

  • When you delete a recorded or uploaded audiovisual file, We will no longer store that file.
  • When you unsubscribe your premium membership and return to an ordinary member, We store your data for the period provided under the Terms of Service.
  • In addition to the aforementioned, We store and use various data during the existence of your member account, and/or the purposes specified in this Privacy Policy for data collection.
  • Where the specific purpose for data collection ceases to exist (completed or no longer applicable), where you exercise your legal right to erasure, or where you delete your member account, We will stop storing any data from which you or your baby is identifiable, unless there is a requirement by law, or a legal basis for Us to store such data.

6. How do We protect data

We understand the importance of data protection to you and your baby. Though no network transmission or electronic storage is 100% secure, We endeavor, with appropriate technological and organizational arrangements, to ensure the consistency of Pixsee Services’ data security with state of the art, to maintain the confidentiality, integrity and availability of such data, to prevent illegal or unauthorized access to such data, and to protect such data from theft, alteration, damage, destruction, disclosure or other forms of infringement.
We take measures including but not limited to the following:
  • Encrypted data transmission with Transport Layer Security (TLS) v. 1.2 or above;
  • Personal data stored as garbled code with AES 128-bit encryption;
  • Identity authentication with username and password;
  • Backup synchronization to Azure for storage; and
  • Selection of third-party service suppliers with a high level of information security, supervision and audit of such third-party service suppliers.

7. Data Breach Notification and Handling Procedures

  • We are committed to maintaining the security and integrity of our products and services. If you identify any potential security vulnerabilities related to the Pixsee Smart Baby Camera or Pixsee services, please contact our technical service team at operator.pixseecare@pixseecare.com and await further communication from our authorized representatives.
  • Our objective is to notify you within 72 hours of any data breach incident that may affect your rights, conduct a vulnerability assessment within 5 business days, provide an initial response within 10 business days, and implement corrective measures within 90 days.

8. Your rights as a data subject/how to exercise such rights

You may exercise the following rights over your data. When you do, We will respond to your request within the legally prescribed time period, unless otherwise required by Our applicable law. You will not be adversely affected by the exercise of such rights.
  • To access your personal data, including making an inquiry thereof, reviewing or requesting a copy thereof. You also have the right to know the purposes of Our collection of your data, the content of the collected data, the use of the collected data, the storage period of the collected data, and the persons to which the collected data are disclosed, among others.
  • To supplement or correct your personal data.
  • To impose limit to/to demand the cessation of the collection, processing or use of, or to demand the erasure of your personal data:
    • You have the right to restrict or request that We cease the collection, processing, or use of your personal data, as well as the right to request its deletion. To permanently delete your personal data, you must terminate your member account. Please log in to the application and follow the on-screen instructions to complete the account deletion process. Once the deletion is finalized, you will no longer be able to access the application or use Our services. Account termination shall be deemed a withdrawal of your consent to use Pixsee services. Upon completion of this process, all data associated with your account will be permanently removed from the Pixsee smart baby camera, the application, and any third-party cloud services. We will not retain any of your personal information. Please note that once your account has been terminated, it cannot be restored. You will bear full responsibility for any loss or inconvenience resulting from this action, and We will not be able to recover any deleted data.     • If you encounter any operational issues, you may contact Us via email at support@pixseecare.com to exercise your rights as a data subject.
    • If there is a dispute regarding the accuracy of your personal data, you may impose limit to or demand the cessation of the collection, processing or use of your personal data, unless the processing or use is necessary for Our business operation, or has been agreed to by you in writing (with the dispute recorded).
    • When the specific purpose of data collection ceases to exist (completed or no longer applicable, e.g., when you terminate your membership), or upon expiration of the relevant time period, you may impose limit to or demand the cessation of the collection, processing or use of your personal data, unless the processing or use is necessary for Our business operation (e.g., legally prescribed time period for data storage, or unfinished accounting process), or has been agreed to by you in writing.
  • To demand the cessation of use of your personal data for marketing purposes:
    When We use your personal data for marketing purposes (e.g., sending promotional email), you may object to such marking practice by clicking the “unsubscribe” button in such email or contacting Us.

You may view, supplement or correct your member information, or delete/download materials in the Application album (available for the period described in your membership plan), by signing in to your account on the Application or Website. You need to sign in with your username and password, or otherwise verify your identity (or that of your agent), before We process your request.
Please be advised that, to ensure our overall user experience, you could only thoroughly erase your member information by deleting your member account.

9. Protecting children’s privacy

Pixsee Services are designed to automatically capture the precious moments of the child. As such, when you use Pixsee Services, We will collect, process and use the child’s voices, images, videos or other data. By accessing and using Pixsee Services, you present yourself as the statutory representative of the recorded child, and give consent to Our collection, processing or use of you and the recorded child’s voices, images or videos or other personal data.

10. Legal basis for Our collection, processing and use of data, and your right to lodge a complaint

If you are a resident of the UK or the European Economic Area, We make the following additional statement to you in accordance with relevant regulations such as the Data Protection Act 2018 (DPA) and the EU General Data Protection Regulation (GDPR):

This Privacy Policy will be updated from time to time, so as to adapt to the development of Pixsee Services, the adjustment of Our policies, or the evolution of the legal framework. We will inform you of such changes in an appropriate manner. In the event that you refuse to accept any update of this Privacy Policy, please immediately stop using Pixsee Services and contact Us. By continuing to use Pixsee Services upon the entry into effect of the notified change, you accept and agree to be bound by such change, in which case We will provide services in accordance with the notified change.
